Lady Solicitor Personal Injury Claim Lady Justice Old Bailer

Accidents Suffered as a Trespasser

Occupiers of premises don’t owe the same duty of care to trespassers as they do lawful visitors. However, occupiers should still take reasonable steps to minimise any hazards or risks which could result in injury to a trespasser, and ensure they are safe from harm whilst on the premises.

If a trespasser suffers an injury, the court will consider whether the occupier has acted reasonably. Factors such as the age of the trespasser will be taken into account. Children are less aware of risk than adults and more prone to injury. Other factors include whether the trespasser suffered injury as a result of taking unnecessary risks, or whether the injured person had been warned of any potential hazards.
