Allegations of Contributory Negligence Withdrawn in Residential Home Accident Claim

Mrs D, from Birchgrove in Swansea, worked in a residential home for adults who required assistance with daily living. The home was located in Llanelli, South Wales.

As Mrs D was making her way into the kitchen from the back of the home, she caught her foot in a sunken drain, tripped and fell, sustaining an injury to her ankle and wrist.

We agreed to pursue her claim under a No Win – No Fees agreement.

A letter of claim was sent to Mrs D’s employers on the basis that the accident occurred as a result of a defect which was likely to cause injury.

Initially, contributory negligence was alleged, but after further negotiation we were able to convince the Defendants to meet the claim in full.

A medical report was obtained from a local Orthopaedic Surgeon and following disclosure of this Defendants agreed to pay an appropriate level of compensation for her injuries and other losses.
