Our client, from Basildon in Essex, was employed by the defendants as a welder/fabricator. He was using a pillar drill at work when the sleeve of his overalls became caught in the drill mechanism. As a result he suffered a fracture to both the radius and ulna of his right arm.  Our client required surgery and a plate and pins were inserted.

We agreed to deal with the resulting compensation claim on a fully funded, No Win – No Fee basis.

A letter of claim was issued by us and the defendants quickly admitted liability.  Medical evidence was then obtained. 

First offer rejected

Unfortunately the claimant failed to make a speedy recovery from his injuries and further surgery was required. 

The defendants offered compensation of £30,000.

The medical evidence had not been finalised and on our recommendation the offer was rejected.

Further complications

Our client underwent further surgery to remove the metalwork from his forearm and required a period of rehabilitation before returning to full time employment.  It was the opinion of the medical expert that he would be prevented from continuing with his employment to normal retirement age.  The expert estimated he might have to retire between 5 to 10 years early.

We argued that the claimant’s prospect of early retirement should be factored in to the compensation settlement, with an allowance for loss of future earnings

After further negotiations between the parties the claim was finally settled for compensation of £87,500.
