Injury Compensation for Birmingham Cleaner

Mrs H, who lived in Alvechurch, Birmingham, was employed as a part time cleaner at a mobile phone store at the Kingfisher Centre in Redditch.

During the course of Mrs H’s employment, a new industrial buffer machine was delivered to the premises. Mrs H had advised her employers that this was not necessary or practical.

When the buffing machine was delivered it was left in a position that restricted access to the delivery doors and storage areas. Mrs H attempted to move the buffing machine and in doing so, suffered a strain to her left wrist. Mrs H tried to continue with her work but unfortunately had to take time off due to the injury which took quite some time to resolve.

A personal injury claim was commenced against Mrs H’s employers who denied liability for the accident. We therefore obtained an opinion from a specialist personal injury barrister and arranged for a medical expert to be instructed. Formal Court proceedings were then issued and then served upon the Defendants. All of this was done on a no win – no fee basis without any cost to Mrs H.

Following service of the court proceedings, the Defendants’ solicitors made an offer on a ‘without prejudice’ basis to settle Mrs H’s injury compensation claim for £7,800. Mrs H, who had only been seeking to recover her lost wages, was more than happy to accept the offer and her accident claim was concluded on this basis.

Under our New Deal, Fair Deal scheme, Mrs H received her compensation in full, without any deductions being made.
