SUPERMARKET SLIPPING AND TRIPPING CLAIMS

If a customer slips in the aisle of a supermarket, shop or store and suffers injury, they may well be entitled to bring an injury claim against the supermarket for compensation.

The owner of the supermarket, shop or store owes its customers a duty of care under the Occupiers Liability Act 1957. The Occupiers Liability Act obliges shop and supermarket owners to take “reasonable” steps to ensure that the premises are reasonably safe for its customers. This duty applies to everyone using the shop, so it's not just shoppers who are protected but also people such as delivery drivers and shop staff.

The key word here is “reasonable” and there is often a great deal of debate among personal injury solicitors about what is and what is not ‘reasonable' in any given situation.

The reasonableness test means that shop and supermarket owners are not obliged to ensure that the aisles and floors are completely spotless. It is also recognised that, with a heavy footfall of customers, items of food will get dropped on to the floor and spillages will occur.  Shops and supermarkets are not expected to have an army of staff standing by, ready to respond immediately a stray grape is dropped. Shops and supermarkets are only expected to do what is reasonable.

This means that in practice, shops and supermarkets need to devise and implement systems to ensure that their customers are reasonably safe. They are expected to carry out regular inspections and to clean up any hazard or spillage if it is found.

When an injury claim is made against a shop or supermarket the owner of the store will have to demonstrate that they had an adequate system of inspection in place and that this system was followed by the shop's staff.

People sometimes think that big household name supermarket chains like Sainsburys, Tesco and Morrisons or fast food shops such as McDonalds, Burger King and KFC will have bulletproof systems in place. However, this is not always the case.
