Successful MIB Claim against Car Driver with No Insurance

Mr C was walking home in Yeovil, Somerset, in the early hours one morning when he was hit by a vehicle which drove over his arm, causing significant fractures to his elbow.

He asked us to handle a compensation claim on his behalf.

It was not possible to pursue the driver’s insurers directly. However the insurance industry has set up a compensation scheme known as the Motor Insurers Bureau (or MIB) which deals with both untraced and uninsured drivers.

The MIB agreed to deal with the injury claim, but issues were raised regarding Mr C’s part in the accident and eventually liability was agreed on a 50:50 basis.

Following surgery a medical report was obtained by an independent medical examiner in Bath and as a consequence the MIB put forward an offer to settle the claim. Further evidence was obtained detailing Mr C’s out of pocket losses, including travel expenses, the cost of care and loss of earnings. As a consequence the MIB increased their offer and Mr C was awarded £18,000 compensation for the injury despite the fact that no insurance company could be pursued.
