The Slee Blackwell personal injury team have successfully won compensation for a resident of private flats in Westward Ho! North Devon, who suffered a serious shoulder injury in an accident.

Our client had returned home to her flat after her day’s work and had taken her rubbish bin outside for collection. She knew that renovation work was being carried out around the block, but unknown to her, a local contractor, trading as South West Property, had dug up paving on a communal walkway, leaving a substantial lip to a paving edge. No warning had been given of this work and since it was dark, she had no idea that it had been done since she left her flat that morning.

She tripped and fell, suffering a serious injury to her shoulder when she slammed into the nearby wall. To make matter worse, the contractor, turned out to be uninsured.

Mike Clarke, the accident solicitor who dealt with the claim said, “This accident claim looked to have fallen at the first hurdle, since there is often little chance of getting compensation from an uninsured trader; but after a lot of research, we managed to bring a claim against the management company that maintained the flats and which had commissioned South West Property to do the work. We argued that the company had a duty to ensure the work was carried out safely by a reliable contractor and that by failing to check the Devon company’s insurance position, they had fallen short. The company’s insurers initially denied liability but then conceded that they would have to pay compensation. My client’s injury was disabling and meant she had to change her job. She is left with permanent limitations in the shoulder but at least she has now received a fair amount of compensation for the pain and distress she went through, as well as for her other losses and expenses caused by this injury.”
